Trump Slams 'Unfair' SCOTUS Ruling, Vows to End Birthright Citizenship Anyway

President Trump did not mince words following the Supreme Court's decision striking down his executive order on birthright citizenship, calling the ruling "bad" and "very unfair" and arguing the country suffers as a result. "I thought we were going to win it at the Supreme Court. Unfortunately, we had a bad decision, very unfair decision," Trump said, making clear the fight is far from over despite the setback. The 6-3 ruling, authored by Chief Justice John Roberts, struck down the president's day-one executive order that sought to deny automatic citizenship to children born in the United States to undocumented immigrants and temporary visa holders.

Rather than accept the outcome as final, Trump signaled the administration intends to pursue the policy through alternative means, telling reporters the effort would continue "in a different way." That framing echoes comments from allies on Capitol Hill, including House Speaker Mike Johnson, who noted in the ruling's aftermath that Congress retains the ability to legislate on the statutory question even though the Court's constitutional holding stands. The decision reaffirmed a legal principle dating back more than 150 years under the 14th Amendment's Citizenship Clause, which the Court found guarantees citizenship to nearly all persons born on U.S. soil and subject to its jurisdiction.

The ruling represents one of the most significant legal defeats of Trump's second term, closing off the executive branch as a pathway to reshaping birthright citizenship and shifting the battle toward Congress or a future case that could prompt the Court to revisit the question. Legal scholars remain divided on whether any statutory workaround could survive judicial scrutiny given the constitutional basis of the Court's holding. For now, Trump's blunt public frustration signals that his administration has no intention of treating the Supreme Court's word as the final chapter in its push to redefine who qualifies as an American citizen.
