A dispute over emergency radio access for the Haredi public reached the High Court on Wednesday, as Supreme Court President Yitzhak Amit questioned whether there remains sufficient security justification for allowing Haredi radio stations Kol Chai and Kol Barama to expand their broadcasts into northern Israel.

The expanded broadcasts were authorized by Communications Minister Shlomo Karhi under emergency provisions of Israel's Communications Law, with the stated goal of ensuring that populations relying on sector-specific radio stations can receive emergency warnings and instructions.

The arrangement covers five regional stations, including the Haredi stations Kol Chai and Kol Barama, and allows them to broadcast outside their ordinary licensed areas.

The issue is particularly relevant to portions of the Haredi population that use kosher cellphones and may not have access to smartphone-based emergency alerts.

Kol Chai began broadcasting in northern Israel on 93 FM in late July, reaching areas including Tzfas, Meron, Tiveria, Haifa, Rechasim, Carmiel, Afula and the Golan Heights. The station said the expanded coverage would also carry Home Front Command alerts, including through its silent emergency broadcast system on Shabbos.

The Home Front Command's position has become a central issue in the legal battle.

According to court filings reported this week, Home Front Command chief Maj. Gen. Shai Klapper initially did not identify a weekday operational need for expanded broadcasts, beyond emergency arrangements such as a silent channel on Shabbos. At the end of July, however, the command changed its position and identified an alerting gap affecting Haredi residents in the north.

Attorney General Gali Baharav-Miara has challenged that assessment.

In her submission to the High Court, the attorney general argued that there was insufficient factual and professional evidence establishing a concrete security necessity for extending the stations' broadcast areas.

Her position also noted that the Israeli Public Broadcasting Corporation offered to provide emergency instructions through Kan Moreshet, an existing nationwide religious radio station.

During Wednesday's hearing, Amit questioned whether the expanded broadcasts remained justified while the country's current emergency classification is at the “green” level.

He suggested that the expanded broadcasts could be stopped for now and restored immediately should the security situation deteriorate.

Importantly, that was a proposal made during the hearing — not a final High Court ruling ordering Kol Chai off the air.

The case also involves a broader regulatory dispute. Opponents of the expansion argue that permitting regional stations to reach new areas provides them with a potentially significant commercial advantage without the normal competitive process.

Similar concerns were raised previously in the Knesset, where representatives of other regional stations argued that emergency needs should be addressed without effectively expanding selected broadcasters' commercial territories.

Kol Chai, meanwhile, has maintained that its expanded coverage provides an important service for Haredi residents who rely on the station, particularly during emergencies and on Shabbos.

The dispute now leaves the future of the station's northern expansion hanging on the outcome of the High Court proceedings.
