Senator Mark Kelly responded publicly after the Pentagon confirmed it is escalating its review of allegations against him into an official command investigation, a move that could carry serious consequences for the retired Navy officer.

The Pentagon announced Monday that what began as a preliminary review has now advanced into a formal Command Investigation following what it described as “serious allegations of misconduct.” A Defense Department spokesperson said the escalation stems from Kelly’s appearance in a November 18, 2025, video alongside five other Democratic lawmakers in which they urged U.S. service members to disobey unlawful orders amid post-election tensions.

Because Kelly is a retired Navy captain, the investigation could potentially involve provisions of the Uniform Code of Military Justice, depending on the findings. Military officials emphasized that the process is ongoing and did not indicate a timeline for completion.

In a video response released Monday night, Kelly defended his remarks, arguing that advising service members to refuse unlawful orders is a foundational principle of military training and discipline. He cited long-standing doctrine and UCMJ Articles 90 through 92, which govern lawful and unlawful orders, asserting that his comments reflected established military standards rather than political activism.

Kelly also accused President Donald Trump and Defense Secretary Pete Hegseth of abusing their authority by targeting him for political reasons. “If Donald Trump or Pete Hegseth think they can stop me from doing my job and serving the American people, they’ve got the wrong guy,” Kelly said, vowing to continue his Senate work without interruption.

The senator framed the investigation as an attempt to intimidate him, while reaffirming his focus on legislative priorities, including opposing healthcare premium increases and tariff hikes. Critics, however, argue that lawmakers—especially those with prior military rank—must exercise extreme caution when addressing active-duty personnel to avoid undermining the chain of command.

The case adds to growing tensions between the Pentagon and Democratic lawmakers in the aftermath of the 2024 election, as civil-military boundaries and political speech involving the armed forces face heightened scrutiny.
